If the claimant disputes a payment schedule and/or a performance security schedule, the claimant may apply to Adjudicate Today for adjudication of the claim.
Review the requirements of payment schedules and performance security schedules to determine whether the schedule served on the claimant meets these requirements.
If the claimant has not received a schedule from the respondent, review respondent does NOT serve schedule.
If the claimant disagrees with the scheduled amount or full payment is not made by the due date, the claimant may proceed to prepare and lodge an adjudication application.
Adjudication is a quick and cost effective dispute resolution process for building and construction industry participants to recover progress payments and performance securities that are due. It represents an alternative to the often slow, expensive and difficult process of litigating payment disputes through the courts.
The process is simple and rapid. The adjudicator must make the determination within 10 business days (unless the parties agree to an extension of time) from when the adjudicator notifies the parties of acceptance of the adjudication application or from the latest day on which the respondent may lodge an adjudication response.
After adjudication, and if the respondent does not pay or release any determined amount by the relevant date, the claimant takes the adjudication certificate (available on application to Adjudicate Today) to the appropriate court and registers it as a judgment debt.
