This section provides guidance for the claimant in completing an adjudication application where the claimant has received a valid payment schedule which is for an amount less than that claimed.
An adjudication application:

Failure to comply with the strict time frames under the Act will cause an application to fail.
If the schedule is received within 10 business days after service of a claim (or shorter time required by the relevant construction contract), but the scheduled amount is less than the amount claimed, the Adjudication Application is due to be lodged within 10 business days.
Example: The Claimant served a claim and the Respondent replied with a schedule, but the Claimant disagrees with the amount scheduled by the Respondent because it is less than the amount claimed. The Claimant has 10 business days from receiving the Respondent’s schedule to lodge an Adjudication Application.
Calculation: Date of receipt of schedule + 10 business days = application deadline.
The claimant MUST serve a copy of the Adjudication Application on the Respondent within 3 business days after lodging the application with Adjudicate Today.

Claimants are strongly advised to keep a record of the time, date and manner of service on the Respondent. The time for the Respondent to provide the Adjudication Response (if eligible) runs from the date of receipt of the Adjudication Application. A Respondent may deny receipt of the Adjudication Application in which case the claimant must be able to evidence the date of service.
It is usually not sufficient for the claimant to merely refer to the claim and the respondent's schedule and state that the claimant is entitled to payment. The submission should:
The overall submission should be concise, clearly written and set out the claimant's arguments and reasons.
Upon receipt of the application, Adjudicate Today nominates an appropriate adjudicator from our panel of registered adjudicators to determine the matter. Adjudicators cannot be pre-appointed under a construction contract.
Within 4 business days of receipt of an application, Adjudicate Today will provide a formal Notification of Acceptance of the adjudication application on behalf of the appointed adjudicator.
On accepting an adjudication application, the adjudicator is taken to have been appointed to determine the application. Details regarding the adjudication process may be reviewed in detail on the Adjudication Determination page.
